>PHILIPSBURG:---- The new coalition in parliament or the governor of St. Maarten should seriously consider filing a criminal complaint against the ministers based on the "ley Suzy" law says former Minister of Constitutional Affairs and former Minister of Justice Roland Duncan.
Duncan said this is an article of the Criminal Code that states if a Minister deliberately acts or omits against better knowledge he/she is acting criminally. Duncan said the “ley Suzy” law which is in the criminal code, is a law he said was proposed by former Minister of Justice of the former Netherlands Antilles Suzy Romer.
Duncan said the advice given by the judges are clear where it states that that the Gumbs cabinet has a legal obligation under article 33 to resign after a motion of no confidence was given.
Duncan further said that while he is no longer a politician and is not on anyone side, he strongly believe that the country St. Maarten is being put to shame by some people that are playing tit for tat or wants to give a last lick. The governor does not need the current ousted Prime Minister to sign any documents for the new prime minister to take office and as such the governor should appoint a formateur to form the next government while taking legal actions against the ousted Gumbs cabinet.
The governor of St. Maarten also has the right to file a criminal complaint against the Gumbs cabinet. As a matter of fact the governor did not need the advice from the judges because the constitution of St. Maarten is crystal clear on these two articles, Duncan said.

The Governor of St. Maarten issued several calls to the Gumbs cabinet to submit their resignations and act in the best interest of the people of St. Maarten since the motion of no confidence was passed on September 30th but despite his personal meetings and public appeal all of his calls and appeals has gone on deaf ears.
