FRENCH, Quarter - The Collectivity needs to complete the unfinished work that is needed (in excess of E20, 000) for each Carbet, or allow us to deduct that expense from future rents.

**The 3-page COMPLAINT letter addressed to the President, Madame Aline Hanson from the concessionaires at Orient Bay that accepted the keys, is evidence of the extensive work that each Carbet requires.

I do not understand how the Collectivity could have accepted this project as complete.

The unfinished work is as follows:The decks need to be covered. As is evident in the photo, the original covering that the Collectivity provided is ridiculous.   There is neither shade from rain or sun or sand. We must now cover our own decks and the Collectivity has demanded that we not use T1-11 to construct the covering. The average cost to cover the deck with the tarp that the government should have used in the first place is E2, 800.00.If, as the Collectivity says, the kitchens are in conformity with required norms, WE WOULD LIKE A DOCUMENT SO STATING. Having been on the beach for over 30 years, we have always been required to have an emergency shut-off switch for gas and electricity; a floor drain in the kitchen; grease pit. The roof constructed out of “sheetrock” requires us to hire a carpenter to make reinforcements in order to support the normal exhaust fan.There has been no provision made for a bar. We must construct our own and install a sink. However, we will need the Collectivity to run a water and electrical line to connect with the main line, wherever that may be.There should be a difference between the rate for the high season and that of the low season. E2,200.00 for the entire year is vindictive. This part of the beach has never been opened at night, and it will take some time to build up that particular business. The majority of our business is between 10:00am and 4:00pm with cruise ship passengers. I understand that there are people willing to pay E3,000 per month. I would dare to ask what type of businesses they plan to bring to our beaches.We need the same delay in the payment of rent (October 1st, 2016) that is afforded to metropole tenants.We need the contract extended from 3 years to 5 years. After making this considerable start-up investment coupled with payroll, social service expenses and utilities, marketing etc., it is very unlikely that we will see a return on investment in just 3 years. There is no guarantee that the contract will be renewed.6.ROLLIN GLASCOW –WATERSPORT OPERATOR – Mr. Glascow is still waiting to be relocated. This gentleman has serious health challenges and cannot be in constant bickering with the concessionaires of “Le String”. It should be quite evident that he has to be accommodated elsewhere and SOON!! He needs to work. Everyone has a family and he cannot pay if he cannot operate his business.7.Collectivity to keep road (on the Club Orient side) graded from the end of the concrete to the entrance into the Carbet parking lot. Otherwise, taxi and bus drivers have explicitly said they will not use that entrance.8.Victor Rodriguez, Chef de Service at Orient Bay (or whoever is assigned this job) must be given the authority and backing of gendarme to enforce all regulations. Boutiques and Watersports cannot be selling food & alcohol and renting chairs. All entrance doors to Carbets must remain unobstructed. Repeat offenders to be fined. We have gone from 8 restaurants, 2 watersports and 6 entities selling clothes (approximately 16 businesses) to 8 restaurants, 3 watersports, 4 boutiques and 10 small concession stands (25 businesses). There are still small, independent vendors walking up and down the beach. There has to be someone who will be meticulous in keeping order.9.Collectivity responsible for cleaning the beach.10.Compensation for our buildings that were demolished.

LIST OF DEMANDS

We are primarily referring to the following unkept commitments of the Collectivity contained in the Memorandum of Understanding dated October 22, 2015:

-       The collectivity committed to “change the competency field of the 50 pas géométriques Committee by including the verification of titles and pricing issues”. We therefore demand that this Committee be convened within two months to revise and decide on the symbolic purchase pricing of the parcels, as promised about 50 years ago, and not “ the market pricing” as recently imposed.

-      

-       The Collectivity also committed “to guarantee the proper functioning and to better take into consideration the grievances of the Community Councils in respect of the organic law”. We therefore demand that the Collectivity respect and take into consideration the following grievances and projects of the Community Councils:

-      

District N° 1

Rectify the scandalous and inadmissible situation of the Lessees in Orient Bay;

District N° 2

Burying the cables and services lines in the District, particularly in Grand-Case;

District N° 3

                        Create a community center and activities for the young people.

District N° 4

                        Improve, visually and environmentally, the entrance of Marigot at Agrément

District N° 5

                        The housing situation on the hill in St James requires special attention: sewage, water,                               electricity, hygiene and sanitation, etc…

District N° 6

                        Resolve and finalize the problems regarding the titles, as well as the sale and purchase of the                     “50 pas géométriques”.

On the other hand, we deplore the disregard shown of the Decree from the President of the Territorial Council prohibiting the commercial use of the beach in Grand-Case. We therefore demand the immediate enforcement of this Decree. Have any investigations, reports of infractions and violations been done? Do we have any results of condemnations? What is the value of such an important Decree without its implementation?

We encourage all the inhabitants of Grand-Case to preserve this environment and restore its natural aspects as a beach for all residents.

1. Economical, financial, and social situation

In order to secure the social balance of our island society, it is crucial to put an end to the deplorable loss by the indigenous people of mastering our economical, financial, and social situation compared to the benefits enjoyed by those coming in from elsewhere. We therefore demand that the following measures be implemented:

-       Stop the eviction of the Saint-Martin lessees, who are conducting business at the Esperance Airport in Grand-Case,

-       Stop the systematic replacement of Saint-Martin employees all over the island by others that are “imported”,

-       Control the regular flow of seasonal workers, above all those coming from France, with regard to labor laws.

-       Revise the tax rate of revenues from the RSA “Socle” towards decrease or even elimination thereof,

-       Exercise efficiently the competences of the Collectivity relative to immigration control as provided by the organic law and extend the field of competences of the Collectivity in matter of control of entry and stay of foreigners,

-       Stop the Waterfront Project in Marigot, given away in concession to outside companies, without any benefit for Saint-Martiners.

2. Protection of Consumers

We demand more reasonable and fairer treatment in the following circumstances:

-       Immediately stop the practice of late issuance and reception of bills from most utility companies, which systematically results in fees for late payments (EDF, Orange, Générale des Eaux)

-       Stop the practice of additional fees for payment of bills at the Post Office (Orange). Why not hire Saint-Martin employees to receive payment of the water and phone bills in Saint-Martin?

-       Send out regular bills every month or every two months and allow the use of approved payments (cash, check, bank card, internet or automatic bank transfer) according to personal convenience,

-       Immediately revise the exorbitant tax rate on water and electricity services,

-       Eliminate the non-existent sewage service charged by the water company,

-       Decrease the price of airline tickets particularly between our neighboring islands, as these prices almost match the price of a ticket to Europe or the US.

3. Prevention and Security

We propose the gradual establishment of the following structures:

-       Detention center / prison for adults

-       Detention center for young delinquents

-       Center for the protection of women against domestic violence

-       Emergency Call center to avoid depending on the one in Guadeloupe (ambulance service)

-       Create a Territorial Fire and Rescue Service and increase the number of firemen

-       Create a Commissariat de Police with a 24 hour permanence.

4. Protection and valorization of Our Heritage

-       Rediscover our wells

-       Restore the Grand-Case Bridge

-       Restore the Grand-Case Wharf

-       Restore our old houses

-       Protect our rock walls

-       Clean up our natural sites
